Reservation Policy & Vacation Rental Agreement

• Valid government-issued identification and a matching credit card are required at check-in.
• All guests must complete the registration form within 24 hours of arrival. Failure to do so may result in deactivation of the access code and/or immediate eviction.
• If registration is required by the property, guests must also register directly with the property upon arrival.

EARLY CHECK-IN / LATE CHECK-OUT
Available at select properties at 50% of the non-discounted daily rate, subject to availability.

RESERVATIONS & PAYMENTS

DEPOSITS & FINAL PAYMENT

• A deposit of 30% of the total reservation value is required at the time of booking.
• Full prepayment is due 60 days prior to arrival (90 days for Christmas/New Year’s; 120 days for stays of 28+ nights).
• Your final payment will be automatically charged to the credit card on file on the applicable due date unless auto-charge is declined.
• A confirmed reservation letter will be sent after the rental agreement is signed.

TAXES

• All rates are subject to the 15.712% Hawaii State GE/TA Tax and the 3% Maui County Tax, as required by law.
• State and County taxes are subject to change. Any adjustment will require full payment prior to check-in, even if the original full payment has already been made.

ACCEPTED PAYMENT METHODS

• Visa, MasterCard, Discover, and AMEX are accepted.

FEES & RATES

• Rates are subject to change and are based on standard occupancy.
• All reservations are subject to a Guest Service Fee that may include cleaning fees, resort fees, and other applicable charges.
• Additional cleaning fees apply for stays of fewer than 5 nights, where applicable.
• Guests and any involved third parties (including travel agents or OTAs) are responsible for verifying all reservation details, including, but not limited to, rates, fees, property, and unit number.
• Ali’i Resorts is not responsible for third-party errors in photos, rates, or information.
• Ali’i Resorts reserves the right to cancel bookings resulting from pricing errors.

3. TRAVEL INSURANCE

We strongly encourage all guests to purchase travel insurance to protect against unforeseen events including wildfires, illness, hurricanes, or other emergencies affecting you, your traveling party, or your family.

Through Rental Guardian, one of the largest global insurance carriers, we offer comprehensive coverage that can be added to your reservation, including a Cancel For Any Reason (CFAR) option. We recommend purchasing coverage as early as possible in the booking process for the broadest available protection.

4. CANCELLATION & CHANGES

CANCELLATION FEES

• 60+ days prior to arrival (90+ days for Christmas/New Year’s; 120+ days for Long Stay): A fee of 10% of gross rent or $200, whichever is greater, will be assessed.
• Within 60 days of arrival (90 days for Christmas/New Year’s; 120 days for stays of 28+ nights): No refund is available unless the unit can be re-rented. If re-rented, a pro rata refund will be issued for reservations paid in full.
• If booking was made through VRBO/HomeAway, VRBO’s cancellation policy applies.
• All cancellations are subject to a processing/handling fee.
• Approved refunds will be remitted by check only, mailed to the address on file.

NO REFUNDS

• No refunds are given for unused nights, late arrival, early departure, or no-shows.
• No refunds are issued due to exchange rate changes. Guests are responsible for all exchange rate effects and fees.
• Guests may not unilaterally declare a rental unit unfit for habitation. No refunds are available for early departure.
• Should a guest fail to make payment by the final balance due date, the reservation may be declared in default and all monies forfeited.

5. HOLIDAYS

Christmas and New Year’s reservations are not subject to standard discounts. Minimum night requirements apply based on unit size:

• 1-Bedroom: 10-night minimum
• 2- and 3+ Bedroom(s): 14-night minimum

6. RENTAL OCCUPANCY

STANDARD OCCUPANCY

• 1-Bedroom: 2 persons | 2-Bedroom: 4 persons | 3-Bedroom: 6 persons

MAXIMUM OCCUPANCY

• 1-Bedroom: 4 persons | 2-Bedroom: 6 persons | 3-Bedroom: 8 persons | 4-Bedroom: 10 persons
• Additional guests above standard occupancy are charged $20 plus tax per person, per night.
• Maximum occupancy may not be exceeded at any time. Specific maximums vary by unit — contact Ali’i Resorts for details.
• Occupancy is restricted to the pre-approved number of guests regardless of age. Extra occupants may result in additional charges or immediate termination of the rental contract.
• Children 12 and under are free (no extra-person fee) but count toward maximum occupancy

7. PROPERTY RULES & GUEST CONDUCT

The primary guest is responsible for the safety and behavior of all children in their party, as well as any invitees. Ali’i Resorts is not responsible for childproof accommodations.

• Lawful conduct: No unlawful activity is permitted on or off the premises at any time.
• No illegal substances: The use, possession, or distribution of illegal substances is strictly prohibited.
• Non-smoking: All units are non-smoking. Hawai’i State Law prohibits smoking in all public areas, including beaches. Smoking is prohibited inside the unit and on the lanai, and is permitted only in designated smoking areas (if any). Guests are responsible for any damage caused by smoking, including stains, burns, odors, and debris removal.
• No parties or large gatherings: Properties may not be used for weddings, receptions, parties, or other large gatherings.
• No pets: Pets are not permitted at any Ali’i Resorts property.
• Phone charges: Guests are responsible for all phone charges exceeding the local standard of service and any additional cable charges ordered.

 

8. PROPERTY DAMAGE & GUEST RESPONSIBILITIES

ACCIDENTAL PROPERTY DAMAGE WAIVER

The Accidental Property Damage Waiver provides protection for accidental breakage or damage up to $1,000. Cost is $50, $60, $70, or $80 depending on unit size/location, plus tax, and is non-refundable. This waiver is added to the total reservation cost.

• Damage must be reported to the Ali’i Resorts office prior to departure to be covered.
• Unreported damage will not be covered; the guest will be responsible for all costs.
• Excessive cleaning required after departure will incur additional charges not covered by the waiver.
• Each unit is inspected before arrival and after departure. Charges will be assessed for any damaged or missing items.

AUTHORIZATION TO CHARGE
By booking, the guest authorizes Ali’i Resorts to charge the credit card on file for any damages, missing items, excessive cleaning, fines, or costs incurred to remove the guest from the property

FURNISHINGS

• Furnishings may not be rearranged or relocated. All items must be returned to their original positions before departure.
• If staff must move, locate, or replace items after departure, the guest will be charged a minimum of $100 plus $50 per hour for any additional time required, including shopping and travel time.

9. HOUSEKEEPING & SUPPLIES

• A welcome kit with a starter supply of toilet paper, tissue, bar soap, paper towels, dishwashing soap, and trash liners is provided. These items are not replenished during the stay.
• Housekeeping service is available only at select properties. Mid-stay cleanings, linen exchanges, or towel exchanges may be purchased, subject to availability.
• A minimum of 72 hours’ advance notice is required to schedule additional housekeeping. Services occur between 8:30 AM and 4:00 PM on the scheduled date.
• Depending on the unit, guests may be asked not to be present during elective housekeeping services.
• If any cleaning items were missed or required attention, guests agree to allow housekeeping the opportunity to address the issue before any other remedy is requested.

10. MAINTENANCE, REPAIRS & PEST CONTROL

ACCESS & REPAIRS

• Ali’i Resorts, the owner, or their vendors may enter the property with 24 hours’ notice (except during scheduled cleanings or emergencies) to perform repairs, inspect the unit, or show it if necessary.
• Guests are required to allow reasonable access for inspections and repairs.
• All appliances and electronics — including but not limited to air conditioning units, TVs, DVD players, water heaters, washer/dryers, internet, and phone service — are assumed to be in proper working order upon arrival unless guests are notified otherwise. Ali’i Resorts will work to ensure all equipment is ready for your stay.
• Ali’i Resorts is not responsible for disturbances caused by adjacent properties or nearby units within the same complex. When notified of disruptions due to construction, noise from neighboring properties, or interruptions to available amenities, Ali’i Resorts will communicate with guests and make every reasonable effort to minimize inconvenience. Such incidents do not constitute a refund.
• While equipment breakdowns cannot be fully guaranteed against, guests are asked to report any issues promptly so repairs can be arranged. Equipment breakdowns and the time required for repairs do not constitute a breach of this agreement and do not entitle the guest to a refund or rental adjustment. If a repair technician determines that equipment is in working order and the reported issue was due to guest oversight or neglect, the full cost of the service call will be charged to the guest.

PEST CONTROL

• Each property receives quarterly pest control services that treat pests common in tropical climates. Maintaining a food-free sink, garbage disposal, countertops, floors, and trash will help minimize the proliferation of tropical pests.
• In a tropical climate, especially with open-air conditions common to island properties, pests such as ants, roaches, and rodents cannot be completely eliminated. Their occasional presence is considered a natural occurrence. If you encounter a pest issue, please contact us and we will be happy to address it.
• To make a claim for a refund or discount related to a significant pest issue, guests must first allow 24 hours for Ali’i Resorts to address the matter and must provide within 48 hours a written opinion from an independent, third-party pest control company — one not affiliated with or staying at the rental — that has physically inspected the unit.

11. LIABILITY, DISCLAIMERS & PROPERTY CHANGES

• Ali’i Resorts reserves the right to change the guest’s accommodation. If a unit becomes unavailable, Ali’i Resorts may relocate the guest to a comparable alternate property. The guest may accept the replacement (paying any additional amount owed) or decline and receive a full refund of all rental fees paid.
• Management is not liable for any loss, damage, or inconvenience caused by circumstances beyond its control, including but not limited to, weather, natural disasters, pests, construction, acts of God, illness, flight cancellations, or airline strikes. No refunds are available for losses arising from such circumstances.
• No refunds will be issued for the lack of, or malfunction of, an HVAC unit or internet connectivity issues. Ali’i Resorts will make every effort to restore service as quickly as possible.
• The liability of the property owner and Ali’i Resorts to the guest is limited to the rental monies paid by the guest.
• If an owner sells or transfers a property, Ali’i Resorts will make every effort to inform affected guests and transfer the reservation to an equal or comparable unit, if available.

12. LOST & FOUND

• Neither Ali’i Resorts nor the property owner is responsible for articles lost, stolen, or left behind by guests.
• A $50 handling fee plus shipping costs will be charged for any recovered lost-and-found item returned to the guest. Additional fees may apply depending on circumstances.
• This fee may be charged to the credit card on file or paid by check prior to the item’s return.

13. HOUSE RULES

• Quiet hours vary by property. Please refer to your property’s House Rules for specifics and be mindful of noise from any source so that other residents are not disturbed.
• The property’s House Rules are included in your welcome materials or may be provided by resort management. Guests are responsible for complying with all house rules and for any fines or eviction resulting from violations by themselves or their visitors.
• Some properties impose strict consequences for violations, up to and including eviction or fines.
  Please review your property’s house rules prior to arrival.

14. COMMUNICATIONS & SPECIAL REQUESTS

• Guests with special needs and requirements should contact us in advance so we can assist with arranging or recommending appropriate services.
• By booking with Ali’i Resorts, you consent to receive occasional email communications featuring special offers, upcoming deals, and curated travel inspiration. You may unsubscribe at any time.

15. GENERAL PROVISIONS & AGREEMENT

• This vacation rental agreement is a legally binding contract. The primary guest must provide complete and accurate information; incomplete or inaccurate information may void this agreement.
• Any disputes will first be addressed through good-faith negotiations. If unresolved within 30 days, the matter will be submitted to mediation in Maui, Hawaii, prior to any litigation. Any litigation will take place exclusively in courts located in Maui County, Hawaii.
• This agreement represents the entire agreement between the guest and Ali’i Resorts, LLC, and may be modified only in writing. It is governed by the laws of the State of Hawaii and is binding on successors, assigns, and devisees.
• If any provision is found unenforceable, the remaining provisions remain valid and enforceable, and apply to all occupants of the accommodation.
